Terms of Service

These Terms of Service ("Terms") govern access to and use of the websites, dashboards, signup flows, evaluation tools, player management features, analytics, and related services offered by SportIQ Analytics Inc. ("SportIQ", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who May Use the Service

The Service is designed for sports organizations, governing bodies, teams, agencies, administrators, coaches, evaluators, agents, and other authorized personnel. You may use the Service only if you have authority to do so on your own behalf or on behalf of the organization you represent, and only in compliance with applicable law.

2. Organization Accounts and Authorized Users

Workspace administrators are responsible for inviting users, assigning roles, and controlling access within their organization. If you create, approve, or manage an account for an organization, you represent that you are authorized to do so. Your organization is responsible for all activity that occurs through its accounts, subject to applicable law.

3. Account Security

You are responsible for safeguarding your login credentials and for all activity under your account. You must promptly notify SportIQ if you suspect unauthorized access, compromised credentials, or any other security incident affecting your account or workspace.

4. Customer Data and Required Permissions

The Service allows customers to upload and manage player, athlete, participant, guardian, evaluator, and staff information, including personal information, photos, and evaluation records. You retain ownership of the data you submit, but you represent and warrant that you have all rights, permissions, notices, disclosures, and consents necessary to collect, upload, use, disclose, and otherwise process that data through the Service. This includes any permissions required to handle information about minors.

5. License to Operate the Service

You grant SportIQ a non-exclusive, worldwide, limited license to host, copy, process, transmit, display, and otherwise use customer data solely as necessary to provide, secure, support, maintain, and improve the Service; comply with law; and enforce these Terms. This license ends when the data is deleted from the Service, subject to reasonable backup, archival, legal, and operational retention requirements.

7. Subscriptions, Billing, Renewals, and Taxes

Some parts of the Service are offered on a paid subscription basis. Paid subscriptions may renew monthly or annually until canceled. Billing, payment collection, tax handling, and certain customer self-service billing actions are processed through Stripe and related billing tools. By starting a paid subscription, you authorize SportIQ and its payment processor to charge the applicable recurring fees, taxes, and other amounts due for the selected plan.

Unless otherwise stated in writing, cancellations take effect at the end of the current billing term, and previously paid fees are non-refundable except where required by law. If your organization changes billing ownership or reimbursement arrangements with another organization, any reimbursement between those organizations is handled outside SportIQ unless we expressly agree otherwise in writing.

We may change pricing, packaging, or plan features from time to time. If we do, we will provide notice appropriate to the nature of the change. Continued use of a renewed paid subscription after the effective date of a pricing change constitutes acceptance of the updated pricing.

8. Third-Party Services

The Service relies on third-party products and infrastructure, including Stripe for subscription billing and payment handling, Google reCAPTCHA for anti-abuse controls, and Google Analytics on our marketing pages. Third-party services are governed by their own terms and privacy practices, and SportIQ is not responsible for third-party content, outages, or policies except as required by law.

9. Availability and Changes to the Service

We may update, improve, modify, suspend, or discontinue all or part of the Service from time to time. We do not guarantee that any feature will remain available forever or that the Service will be uninterrupted or error-free at all times.

10. Intellectual Property

SportIQ and its licensors own all right, title, and interest in and to the Service, including its software, interface design, branding, documentation, content created by SportIQ, and all related intellectual property rights. These Terms do not transfer ownership of the Service to you. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal business purposes.

Our collection, use, and disclosure of personal information are described in our Privacy Policy and Cookies Policy. By using the Service, you acknowledge those policies.

12. Suspension and Termination

We may suspend or terminate access to the Service, in whole or in part, if you violate these Terms, fail to pay applicable fees, pose a security or legal risk, misuse the Service, or if suspension is reasonably necessary to protect SportIQ, our users, or third parties. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive, including payment obligations accrued before termination, intellectual property provisions, disclaimers, limitations of liability, and dispute-related provisions.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. SportIQ disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade. SportIQ does not warrant that the Service will be uninterrupted, secure, error-free, or suitable for every use case.

14. Limitation of Liability

To the fullest extent permitted by law, SportIQ and its directors, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunities arising out of or related to the Service or these Terms, even if advised of the possibility of those damages. To the fullest extent permitted by law, SportIQ's aggregate liability arising out of or relating to the Service and these Terms will not exceed the amount paid by the customer to SportIQ for the Service in the twelve months preceding the event giving rise to the claim.

15. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law rules.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised version on this page and update the effective date above. If a change is material, we may provide additional notice through email, the Service, or another reasonable method. Continued use of the Service after updated Terms take effect constitutes acceptance of the revised Terms.
